Responsible Use Policy — Fabapp

This Responsible Use Policy ("Policy") is incorporated into the Terms of Use of the Fabapp platform, operated by FABAPP TECNOLOGIA S.A., CNPJ No. 04.013.941/0001-10 ("Fabapp"), and establishes the conduct required and prohibited in the use of the Platform. Failure to comply with this Policy may result in the removal of content, suspension, or termination of access, without prejudice to other legal measures.
1. Principles
You must use the Platform in a lawful, ethical, and safe manner, respecting the rights of third parties, and you are solely responsible for the Client Content, for the applications you create, and for your use of the Generated Result.
2. Prohibited conduct
You may not, directly or indirectly, nor allow third parties to do so:
a) Unlawful use and prohibited content
- Violate laws, regulations, or third-party rights;
- Publish or generate content that is unlawful, defamatory, slanderous, threatening, harassing, discriminatory, hateful, that incites violence, obscene, or that exploits or endangers children and adolescents;
- Infringe intellectual property, privacy, image, or other rights of third parties;
- Disseminate harmful disinformation, fraud, pyramid schemes, spam, or phishing.
b) Security and integrity of the Platform
- Insert or distribute malicious code (malware, viruses);
- Attempt to access systems, accounts, or data without authorization; circumvent security measures, usage limits, or quota controls;
- Deliberately overload the infrastructure; carry out unauthorized cryptocurrency mining;
- Access the Platform by unauthorized automated means (crawling, scraping, caching), except where expressly permitted.
c) Commercial abuse and competition
- Reverse engineer, decompile, or copy the Platform; create unauthorized derivative works;
- Carry out benchmarking or comparative testing without written authorization;
- Use the Platform to develop a competing product or service or to train competing models;
- Abusively create multiple free accounts or resell access without authorization.
d) High-risk and regulated activities
- Use the Platform or the Generated Result in high-risk contexts (for example, aviation, maritime, rail, nuclear energy, weapons, critical infrastructure, or healthcare) without the proper compliance, redundancy, and human supervision;
- Provide services that require a license or qualification (for example, legal, medical, or financial advice) without holding such license/qualification;
- Present the Generated Result as professional advice.
e) Misuse of AI
- Generate content intended to deceive about its origin (for example, impersonating a real person without authorization) in an unlawful or harmful manner;
- Use AI to produce content that violates this Policy or the law.
f) Sanctions and export control
- Use the Platform in violation of applicable sanctions, embargoes, or export controls, or make it available to parties subject to such restrictions.
3. Responsibility for published applications
When publishing applications, you must inform your End Users about the applicable policies (including privacy), obtain the legal bases necessary for data processing, and comply with the legislation applicable to your business.
4. Reporting
Content or use that violates this Policy may be reported to privacy@fabapp.com. Fabapp may, at its discretion and without any obligation of prior monitoring, review reports and remove content, subject to art. 19 of the Marco Civil da Internet (Brazilian Internet Civil Framework) with respect to third-party content.
5. Consequences
Noncompliance may result in a warning, removal of content, limitation, suspension, or termination of access, and the adoption of the applicable legal measures, according to the severity and recurrence.
